Hotel Parking Garage Rape Lawsuit

Boston jury awards over four million dollars to a 2009 rape victim in a lawsuit filed against Boston hotel owners and parking garage owners who failed to warn the victim and other guests that a previous rape had occurred only days before in the same garage located adjacent to the Radisson Hotel.  The hotel parking garage owners, LAZ Parking did nothing to increase security, did not add cameras or provide any warnings to the parking lot users or hotel guests that the earlier sexual assault had occurred. In fact, Kira W. was the second women to be attacked and raped by Juan Ruben Rivera III inside the parking lot in 2009. Security cameras hidden inside the elevator showed the rape victim entered the same elevator that was used by the rapist miutee before the assualt. The rapist pleaded guilty and was given only 15 years for this rape.

Hotel Parking Garage & Parking Lot Security

One should quickly ask, why did this second rape happen in same hotel parking garage just days after the first sexual assault. As a personal injury lawyer of over 38 years, a husband and father of two grown children I also ask, why did the first hotel garage rape occur too. If the hotel parking garage owner and the hotel owner and managers had been vigilant and protective of their hotel guests in the first place, there is a good chance the first and the second sexual assault and brutal attacks might have been prevented.

In order to help prevent sexual assaults in a hotel parking garage, the garage parking lot owner and hotel management should:

1. Have hired a security expert to visit the garage and do a detailed security assessment and report.

2. Have digital security cameras installed throughout the garage, stairwells, elevators, and different parking levels and at all entrances and exits

3. Install flashing red lights or strobe flashes next to the cameras as a reminder to all that they are being observed and photographed and license plates recorded.

4. Install card readers for hotel security card / room key in order to access the garage or parking areas

5. Have security guards patrolling the parking lots, hallways, stairs especially in high rise or underground parking lots

6. Have security gates installed to prevent non-hotel guests, trespassers or criminals from entering any garage door or entrance

7. Make sure that all exterior walls are of sufficient height to prevent trespassers from jumping a fence or wall to gain entrance

8. Make sure that all hotel guests, and parking lots customers are informed of any criminal activity in that garage or in the vicinity and pre-warned and reminder to be careful before walking the streets in the area if criminal activity is active.

9. Allow any guest that is not comfortable with the ongoing amount security measures or presence of local criminal accivity to check out of the hotel without penalty.

Like we have mentioned hotel and motel rapes whether in the guest rooms, hallways, stairwell, common areas or in the garage, can be prevented if the hotel and parking lots owners are willing to "step up to the plate" and protect the paying guests before the crime occurs. Hotel and motel guests are especially susceptible to attacks as they often are new to town and are not aware of newstories in the paper or on TV of other rapes, sexual assaults or crime in the area and must be pre-warned and the security measures installed must be updated as the conditions change.
